JUICY JUICE FRUIT FOR ALL PROJECT – CHALLENGE DONATION PROGRAM

ELIGIBILITY: Open to legal residents of the 50 United States and District of Columbia who are 18 years of age and older at time of entry. Void where prohibited. Donation Program is subject to all applicable federal, state and local laws. Each person may only use one (1) e-mail address to participate, and such e-mail address may only be used by one person regardless of whether the e-mail address is shared by two or more people.

Challenge Donation Period: The Challenge Donation Program will run from 12:00 am ET on June 1, 2012 through 11:59 pm ET on August 31, 2012 ("Donation Period"). There will be weekly challenges offered during the "Donation Period". Challenges will consist of quizzes, puzzles, games, or photo challenges.
For each challenge completed, a fruit donation will be made to Feeding America. See Challenge Details section for more details.

1. Online: There will be eleven (11) weekly challenges offered during the "Donation Period". Challenges will consist of quizzes, puzzles, games, or photo challenges. A "week" is defined as the Monday beginning at 12:00 am. ET and ending at 11:59 p.m. ET the following Sunday during the Donation Period, except for week one which will start on Friday 6/1/12 and week eleven which will run from 12:00 am ET on August 13, 2012 through 11:59 pm ET on August 31, 2012. Log onto www.FruitForAllProject.com during the Donation Period and follow the onscreen instructions to participate in the current challenge(s). See challenge details section for details.
2. Web enabled device: There will be four (4) quiz challenges offered during the "Donation Period". Only quiz challenges will be offered via web enabled device, all other challenges listed are only available at the website listed above. Visit www.FruitForAllProject.com from your web enabled device or look for the Quick Response Code (QR code) on JUICY JUICE® in-store displays at participating retailers Scan using the QR code reader application on your web-enabled mobile device which will take you to the JUICY JUICE Fruit for All Donation landing page optimized for mobile. In order to participate using a QR Code, your mobile device must have a camera, a QR Code-reading application installed and access to the Internet. QR code readers may not be available through all wireless carriers or on all Web-enabled mobile devices. Installation of a QR reader is subject to your mobile device's compatibility. Once you have scanned the QR Code, follow the on-screen instructions to participate in the challenges. Data rates may apply, please consult your data service provider regarding rate plans. Sponsor does not endorse any particular QR code reader and any download is at the sole risk of the participant.

1. Quizzes, puzzles and games: Follow the onscreen instructions to participate. One piece of fruit will be donated upon completion of each weekly challenge. Participants may complete the weekly challenge as many times as they wish; however a donation will only be made upon the first completion of each weekly challenge.

2. Photo challenge: follow the onscreen instructions and submit the photo requested. Users will be required to provide a photo title and first name, last name, city, state and email to participate. Once a weekly challenge is successfully completed, and/or photo is approved, Juicy Juice will donate one piece of fruit to Feeding America. Photo must meet all of the photo requirements listed below or it will be disqualified and donation will not be made. Eligible photos will be published in a gallery on the website. Participants may complete the weekly challenge as many times as they wish; however a donation will only be made upon the first completion of each weekly challenge.

   Photo guidelines and requirements: Each entry must be original, unpublished, the sole property of submitter.
   • Entries must not violate any third party rights (including, but not limited to, copyrights),
   • Written permission must be obtained from any identifiable person appearing in the photo
   • Entry must not include unsuitable content as determined by Sponsor in its sole discretion.
   • All submissions become the property of Nestlé, and will not be returned.
   • Photo must be relevant to the theme of the photo challenge it is entered into
   • Photos must be in JPEG, GIF or PNG (.JPG, .GIF, .PNG) formats and must not exceed a file size larger than 2MB
   • Photo may not contain, as determined by the Sponsor, in its sole discretion, any content that:
     • Includes any individuals that Participant has not obtained written consent for
     • Includes stock photography
     • Contains any personal identification such as license plate numbers, personal names, e-mail addresses or street addresses of entrant or any third party
     • Violates any third party rights, including but not limited to, copyright, trademark, and rights of privacy/publicity. This means that the Photo should not contain, among other things: (i) copyrighted materials owned by others (including photographs, sculptures, paintings and other works of art or images published on or in websites, television, movies or other media); (ii) any identifiable names or markings of any third-party (e.g., logos or trademarks on clothing); or (iii) materials embodying the names, likenesses, or other indicia identifying any person, including, without limitation, celebrities and/or other public figures, living or dead
     • Is inappropriate, offensive or obscene, as determined by Sponsor in its sole discretion
     • Communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate, as determined by Sponsor in its sole discretion; and/or
     • Violates any law
     • By submitting a Photo you agree Nestlé has the unrestricted right to use your image, likeness, Photo, along with your first name, last initial, city, and state, commercially or non-commercially, including the right to publish and display your image, likeness, Photo for advertising and publicity, all without notice or compensation, nor will Nestlé have any liability in conjunction with such publishing/display of your image/likeness/Photo. You also agree that, should Nestlé decide to publish/display the Photo you submitted, such publication/display is for entertainment purposes only

3. Share the Weekly Challenge: After successfully completing a weekly challenge, if you click on the "Share on Facebook" and/or "Share on Twitter" buttons on the website, one piece of fruit will be donated to Feeding America. You will have the opportunity to share each time you complete a challenge and there is no limit to the number of times you can share the promotion.

4. The Help Fight Hunger Challenge: Follow the onscreen instructions and upload a photo of you and your kids volunteering at a local food bank, feeding agency, soup kitchen etc. Users will be required to provide a photo title, first name, last name, city, state and email to participate. For each valid unique photo submitted, three pieces of fruit will be donated to Feeding America. There is no limit to the number of food bank photos that may be uploaded; however each photo submitted must be different for entry to result in a donation of three pieces of fruit.

5. Share the Help Fight Hunger Challenge: After successfully submitting a photo into the Help Fight Hunger Challenge, click on the "Share on Facebook" and/or "Share on Twitter" buttons on the website. Three pieces of fruit will be donated to Feeding America each time you share the promotion on Facebook or Twitter. You will have the opportunity to share each time you successfully submit a Help Fight Hunger Photo, and there is no limit to the number of times you can share the promotion.

   Donation promotion runs from June 1, 2012 to August 31, 2012. During the Donation Period, Nestlé shall donate to Feeding America the funds needed to deliver up to 35,000,000 pieces of fruit based on in-store sales and completion of online challenges at FruitForAllProject.com. Maximum donation is $420,000.

   RELEASE OF LIABILITY: All participants release Sponsor, Administrator, Facebook and each of their parents, affiliates, subsidiaries, officers, directors, shareholders, agents, employees, and all others associated with the development and execution of this Donation Program, from any and all liability with respect to, or in any way arising from, this Donation Program. Sponsor assumes no responsibility for any injury, loss or damage to participants' or to any other person's computer relating to, or resulting from, entering or downloading any information or software in connection with this Donation Program. Sponsor and its agents are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user, or by any of the equipment or programming associated with or utilized in this Donation Program, or by any human or other errors that may occur in connection with this Donation Program.

   This program is in no way sponsored, endorsed or administered by, or associated with, Facebook. As such, please direct any questions, comments, or complaints regarding the promotion to the Administrator. You understand that you are providing your information to Nestlé USA and agencies acting on its behalf with regard to this promotion, and not to Facebook. The information you provide will only be used in the administration of the Donation Program on Facebook, unless you opt-in for further communications from Sponsor, in which case such information will be used accordance with Sponsor's Privacy Policy, available at http://www.Nestleusa.com/Privacy.aspx.
